1. Scope 
The following conditions apply to the use of EduYou (hereinafter referred to as "EY"). Logging in is only permitted if you as a user accept these terms of use. 


2. Registration, conclusion and object of the contract 
2.1 A prerequisite for uploading any content (post in news feed, images, files, etc.) to EY is registration via the relevant online form and selecting a paid plan see 6.2 & 6.3. After registering using the online form, you will receive a confirmation email to verify your data, which you can use to confirm your registration with a mouse click. With the activation of your account, a free network usage contract comes into effect (conclusion of contract). 
2.2 The subject of the contract is the free or paid use of the social networking service offered by EY as an online communication platform. For this purpose, you as a user will be provided with an "account" with which you can (only) read other contributions and establish contacts with other users. 
2.3 In principle, there is no legal entitlement to activation or participation on EY. The unrestricted domiciliary rights of the operator apply. 
2.4 Your EY Account may only be used by you. As the owner of the account, you are also responsible for protecting it from misuse. Your access data must therefore be protected from access by third parties. The use of trademarked words and Internet addresses as user names (nicknames) is not permitted. 
2.5 EY will endeavor to offer the service with as few interruptions as possible. Even with all due care, downtimes cannot be ruled out when the web server cannot be accessed via the Internet due to technical or other problems that are beyond EY's control (fault of third parties, force majeure, attacks on the infrastructure by hackers, etc.). is available. 2.6 EY reserves the right to change and expand the content and structure of the platform and the associated user interfaces if the fulfillment of the purpose of the contract concluded with the user is not or not insignificantly impaired. 2.7 The purpose of EY is a "market of opinions" aimed at the public. A peaceful and respectful interaction without insulting hostility should therefore be maintained among users. 


3. Obligations as an EY User 
3.1 As a user, you undertake that you will not publish any posts that violate these rules, morality or any other applicable law. In particular, you are prohibited from post offensive or untrue content; send spam to other users through the system; to use content protected by law, in particular by copyright and trademark law, without authorization; engage in anti-competitive activities; Post your topic multiple times in the EY (ban on double posting); Publish third-party press articles on EY without the consent of the originator; To advertise in posts posted under . This also applies to so-called surreptitious advertising such as, in particular, linking to one's own homepage with or without an accompanying text in the signature or within contributions. 3.2 As a user, you undertake to check your posts and topics before they are published to see whether they contain information that you do not want to publish. Your posts and topics can be recorded in search engines and thus become accessible worldwide. A claim for deletion or correction of such search engine entries against the provider is excluded. 
3.3 In the event of a violation, in particular of the aforementioned rules § 3 Paragraphs 1 and 2, EY can also impose the following sanctions on the user, regardless of termination: Deletion or modification of content posted by the user, pronouncement of a warning or Blocking access to EY. 
3.4 EY is also entitled to block you as a user from accessing the online platform if there is reasonable suspicion that you have breached these Terms of Use. You can avert these measures if you suspect submission of appropriate evidence at your own expense. 
3.5 Should third parties or other users sue EY for possible legal violations that a) result from the content posted by you as a user and/or b) from the use of EY services by you as a user, you as a user undertake to indemnify EY from any claims, including claims for damages, and to reimburse EY for the costs it incurs as a result of the possible violation of rights. In particular, EY is released from the costs of the necessary legal defense. EY is entitled to demand a reasonable advance payment from you as a user. As a user, you are obliged to support EY in good faith with information and documents in legal defense against third parties. All further rights and claims for damages by EY remain unaffected. If you as a user are not responsible for the possible violation of the law, the aforementioned obligations do not exist. 


4. Transfer of Use Rights 
4.1 The copyright for your topics and contributions, insofar as they are capable of copyright protection, remains with you as the user. However, by posting a topic or post, you grant the EY the right to keep the topic or post permanently on its websites. In addition, EY has the right to delete, edit, move or close your topics and posts. 
4.2 The aforementioned rights of use remain in effect even if the EY account is terminated. 


5. Limitation of Liability 
5.1 EY assumes no liability whatsoever for the content posted on EY, in particular for its correctness, completeness and topicality. 
5.2 EY is not liable for intent and gross negligence or for breach of a material contractual obligation. Significant contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely. EY is not liable, limited to compensation for the typical contractual damage that was foreseeable at the time the contract was concluded, for such damage that is based on a slightly negligent breach of essential contractual obligations by EY or one of its legal representatives or vicarious agents. EY is not liable for slightly negligent breaches of ancillary obligations that are not essential contractual obligations. Liability for damage that falls within the scope of a guarantee or assurance given by EY, as well as liability for claims based on the Product Liability Act and damage resulting from injury to life, limb or health remain unaffected. 


6. Term / Termination of Contract 
6.1 This Free Account Agreement is concluded for an indefinite period. 
6.2 The paid plan (1 year) is valid for one year and must be extended by the user through payment. If the plan is not renewed, the account will not be deleted but will automatically become a Free Plan (with all its rights). The price for this plan is 60CHF, EY reserves the right to adjust this amount. The amount must be paid in one go and cannot be divided into installments. 
6.3 The paid plan (3 months) is valid for 3 months and must be extended by the user through payment. If the plan is not renewed, the account will not be deleted but will automatically become a Free Plan (with all its rights). The price for this plan is 20CHF, EY reserves the right to adjust this amount. The amount must be paid in one go and cannot be divided into installments. 
6.4 Either party may terminate this Agreement without notice. 
6.5 EY is entitled to block the user's access after the end of this EY contract of use. EY is entitled but not obliged to delete the content created by you as a user in the event of termination. A claim by you as a user to transfer the created content is excluded. 

7.Google Analytics 
7.1 EY uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including your IP address) is transmitted to a Google server in the USA and stored there. Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties if required to do so by law or if third parties process this data on Google's behalf. Under no circumstances will Google associate your IP address with other data stored by Google.
